Habitual Use of Alcohol/Drugs

Ohio Revised Code Section 4507.08 (D)

& Ohio Administrative Code Sections 4501:1-1-16 & 4501:1-1-18 (C)


Cause

Convicted three (3) or more times within the immediately preceding 3-year period of driving under the influence of intoxicating liquor or any combination of driving under the influence of intoxicating liquor or under the influence of a controlled substance.

Length of Suspension

Until Registrar has received a form stating that the person has successfully completed a treatment/rehabilitation program and has maintained sobriety from alcohol or freedom from addiction to a controlled substance for a continuous 6 months from the date the program was completed.

Appeal Procedure

Person has the right to request a hearing by writing to the Bureau of Motor Vehicles within 30 days of the date of the suspension notice.

Reinstatement Requirements:

  1. Attend a treatment/rehabilitation program given by the Alcohol and Drug Addiction Services Board (See County Lists).

  2. Maintain a continuous 6 month period of sobriety or freedom of addiction from date of completion of treatment.

  3. A statement from a licensed physician, a licensed psychiatrist, or a certified alcoholism counselor (CCDC 2 or CCDC 3) attesting that the above requirements have been met must be mailed to:

NOTE:

If a person receives a subsequent conviction within one (1) year of restoration, of driving under the influence or of a controlled substance, the previous suspension will be re-imposed.
